Terms of Service

 

General Terms

These Terms of Service relate specifically to the use of CloudHygiene.com (owned and operated by Webbula, LLC) for the services of email Hygiene, Verification, and Social Media Authentication.

Subject to the terms and conditions of this agreement, Webbula, LLC. grants you a limited, nonexclusive license to use the CloudHygiene.com service to you only upon the condition that you, either as an individual or a duly authorized representative for an entity, accept all of the terms contained in these Terms of Service. Please read the terms and any provided supplemental terms carefully. If you do not agree with all of the terms of this agreement, you shall not install, copy or otherwise use the CloudHygiene.com services. You should maintain a copy of this license for your records.

You agree not to use any automated means, including spiders, robots, crawlers or the like to download data from CloudHygiene.com.

You agree not to enter or upload any data that is libelous, defamatory or unlawful, or that violates or infringes any trademark, copyright or similar rights of others.

You agree not to knowingly enter or upload any data, which is false or misleading at the time of entry.

You agree not to use the CloudHygiene.com service to enter, upload, post, email, transmit or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable.

By using the CloudHygiene.com service you agree not to:

  • use data obtained from the CloudHygiene.com service for spam or other solicitations, commercial or not;
  • use any data obtained from the CloudHygiene.com service as part of a commercial product, service or content offering;
  • sell or otherwise distribute any data obtained from the CloudHygiene.com service;

Webbula, LLC. reserves the right to deny access to any user or group of users to CloudHygiene.com, at its sole discretion, at any time, and for any reason or no reason.

Webbula, LLC. reserves the right to add or remove any data from CloudHygiene.com at any time and for any or no reason.

Webbula, LLC. makes no warranty regarding, the accuracy, integrity or quality of any of the services rendered by CloudHygiene.com.

Webbula, LLC will not be liable for any damages of any kind incurred as a result of the use of the CloudHygiene.com service.

Webbula, LLC. disclaims any and all warranties relating to the CloudHygiene.com service, including warranties of merchantability and fitness for a particular purpose or use.

Webbula, LLC. reserves the right to make any changes to this agreement at any time, without notice.

 

CloudHygiene Purpose & Goals

Webbula’s CloudHygiene platform purpose is to give marketers and their service providers further insight into the data that is being presented to them before hitting the send button.

Without utilizing a platform like CloudHygiene, it would be nearly if not entirely impossible for a marketer to understand the nature of the data handed to them, subsequently forcing the marketer to go on blind faith that the data was obtained properly.

The ultimate goal of the platform is to allow marketers to evaluate data handed to them so that the highest standards in privacy, compliance, and transparency can be achieved.

Webbula does not support, sponsor, permit or condone individuals or organizations whose intentions are to use CloudHygiene as a method to violate the highest standards in marketing which induce abiding by the rules of privacy, compliance, and transparency.

CloudHygiene is not and shall not be a platform to enable violators of privacy, compliance, or transparency to avoid getting caught.

 

Prevention of Abuse

In order to prevent violators from abusing CloudHygiene’s purpose and goals, Webbula has implemented a 3 Occurrence Policy (3 Strike Policy) measuring the times a Honey Pot has been seen.  Spam Traps / Honey Pots are  placed in strategic locations invisible to the human eye and visible only to robots, scrapers, and miners, making them an unbiased identifier of improper data aggregation techniques.

The policy is meant to separate those organizations who stumbled inadvertently on a Spam Trap / Honey Pot versus those organizations who use improper data aggregation techniques such as, but not limited to, bots, scraping, and namespace mining as a business practice.

1st File Occurrence:  The client will be notified by Webbula staff and asked to provide an action plan to identify and stop the source of improperly aggregated data.

2nd File Occurrence: The client will be notified by Webbula staff and asked to provide an action plan to identify and stop the source of improperly aggregated data. Additionally, all future files submitted will be required to have opt-in information as proof of user consent.

3rd File Occurrence:  The client will be suspended from the system. Client will promptly be invoiced for any outstanding billing or usage charges to date.
